Terms of Service

By accessing or using the Bertix platform, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this service.

Bertix provides an Autonomous Customer Operations Platform (ACOP) that enables businesses to automate customer interactions through AI-powered voice and chat operators. Our service includes: - AI voice and chat operators - Integration with e-commerce platforms - Workflow automation tools - Analytics and reporting - API access (based on plan)

To use our services, you must: - Register for an account with accurate information - Maintain the security of your account credentials - Notify us immediately of any unauthorized access - Be responsible for all activities under your account You must be at least 18 years old and have the authority to bind your organization to these terms.

- Subscription fees are billed monthly or annually in advance - Usage-based charges (overage minutes) are billed monthly in arrears - All fees are non-refundable except as required by law - We may change pricing with 30 days notice - Failure to pay may result in service suspension

You agree not to: - Use the service for any unlawful purpose - Transmit harmful, offensive, or harassing content - Attempt to gain unauthorized access to our systems - Interfere with the proper working of the service - Use the service to make deceptive or fraudulent calls - Violate any applicable laws or regulations We reserve the right to suspend accounts that violate these terms.

We process customer interaction data on your behalf to provide our services. You remain the data controller for any personal data processed through our platform. See our Privacy Policy and Data Processing Agreement for details.

- Bertix retains all rights to our platform, technology, and brand - You retain ownership of your content and data - You grant us a license to process your data to provide the service - Our AI models may learn from aggregate, anonymized usage patterns

For paid plans, we commit to 99.9% uptime availability. Service credits are available for downtime exceeding this threshold. Enterprise customers may negotiate custom SLAs.

To the maximum extent permitted by law, Bertix shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

- You may cancel your subscription at any time - We may terminate accounts that violate these terms - Upon termination, your data will be retained for 30 days - Some provisions survive termination (IP rights, limitation of liability)

We may modify these terms at any time. We will provide notice of material changes via email or through the platform. Continued use after changes constitutes acceptance of the new terms.

These terms are governed by the laws of Germany. Any disputes shall be resolved in the courts of Düsseldorf, Germany.
